Images on the site

GESTIMODA SRL declines any responsibility in the event that, due to a particular configuration (or malfunction) of the Customer's PC/tablet/smartphone, the colors of the products on the site are slightly different from the original ones.

The images on the site are the exclusive property of GESTIMODA SRL. Should unauthorized use of the same be detected, such action will be punishable by law.

Availability of Items

The products present on MODAMICA.IT reflect the precise availability of each item by size and color. The authenticity of each item is guaranteed.

It will be checked whether the transaction was successful. If there is no actual availability for the products ordered or if there are impediments to completing the transaction, MODAMICA / GESTIOMODA will communicate this immediately.

Legal Terms

The Customer who accesses the MODAMICA.IT website undertakes to accept the conditions in the following declaration and to respect them.

The site and its related services are exclusively for personal use (of the End Consumer).

The pages that the Customer views serve the purpose of providing information on the products offered with the related possibility of purchasing them.

This contract will be interpreted exclusively according to Italian law.

Any dispute arising from the interpretation and/or execution and/or termination of this contract will be referred to the exclusive jurisdiction of the Court or Justice of the Peace of Bergamo.

Amendments and interpretation of the Contract

Any changes or acronyms to the Contractual Conditions will be effective only and exclusively if approved in writing by the Parties.

Any invalidity or ineffectiveness of one or more contractual clauses will in no case affect the validity or ineffectiveness of the other contractual clauses.

 

 

Property

The documents, images, characters, layout, software, codes and format scripts are the exclusive property of GESTIMODA SRL

Any reproduction, redistribution to third parties and alteration of the aforementioned material is not permitted without prior authorization.

Domiciliation of the parties and Communications

For the purposes of the execution of this contract the parties will be domiciled at their respective registered offices;

All communications relating to the execution of the contract will be carried out and forwarded by e-mail, except for communications for which the law provides for particular forms of notification.

Protection of personal data

The User confirms that he has read and accepted the information pursuant to Regulation (EU) 679/2016 and Legislative Decree 196/2003 and subsequent amendments.

The Parties mutually guarantee that the data provided as a result of this Contract will be processed in compliance with the principles of legality, minimization and adequacy.

The Parties declare that they are aware that communication of the user's personal data is essential for the correct execution of this Contract and that Gestimoda may communicate them to External Managers providing services.
